How do you deal with unscrupulous agents ?\u00a0\u00a0<\/strong><\/em><\/p>\n

In Malaysia, one has to be\u00a0registered with the Board of\u00a0Valuers, Appraisals and Estate\u00a0Agents (BOVEA) in order to\u00a0legally carry out estate agency\u00a0practice.\u00a0Once registered and given an\u00a0authority to practice by way of an\u00a0official Certificate, a registered estate\u00a0agent is regulated by the Board of\u00a0Valuers, Appraisals & Estate Agents<\/p>\n

Act 1981, the Rules 1986 and The\u00a0Standards. The objectives of The\u00a0Act, the Rules and The Standards are\u00a0to ensure that all registered estate\u00a0agents to conduct their estate agency\u00a0practice in an ethical and professional\u00a0manner whereby the image of the\u00a0profession will be upheld at the highest\u00a0level and the interests of the general\u00a0public will be protected.<\/p>\n

But, there are certain cases where\u00a0the agents are so-called \u2018unscrupulous\u2019,\u00a0in which these kind of agents are those\u00a0who \u201cpretend\u201d to be an agent, when\u00a0they are not. Property Insight talks to\u00a0a few real estate principals to find out\u00a0more about unscrupulous agents.<\/p>\n

WHO ARE UNSCRUPULOUS\u00a0AGENTS?<\/strong><\/p>\n

Unscrupulous agents are those who\u00a0conduct their estate agency practice\u00a0in breach of the provisions of the\u00a0Board of Valuers, Appraisals & Estate\u00a0Agents Act 1981, the Board of Valuers,\u00a0Appraisals & Estate Agents Rules\u00a01986 and the standard of practice set\u00a0out in The Malaysian Estate Agency\u00a0Standards, with total disregard to the\u00a0interests of their client for their own\u00a0selfish gains.<\/p>\n

\u201cIn my opinion, the bulk of these\u00a0unscrupulous agents are made up of\u00a0persons who are practicing estate\u00a0agency business without the authority\u00a0from the BOVAEA,\u201d Property Hub\u00a0resident manager Wan Choy Heng\u00a0explains. \u201cThese people are commonly\u00a0referred to as \u201cillegal brokers\u201d. Unsuspecting\u00a0public engaging the services\u00a0of these illegal brokers run the risk of\u00a0being left high and dry in the event of a\u00a0dispute in the middle of a transaction,\u201d\u00a0he says.<\/p>\n

These illegal brokers very often will\u00a0disappear without a trace in the event\u00a0of a dispute, sometimes together with\u00a0earnest deposit, leaving behind both\u00a0the vendor and the purchaser helpless\u00a0with no recourse because the business\u00a0operations of these illegal brokers\u00a0are not authorised by the BOVAEA,\u00a0according to Wan.<\/p>\n

Because of their illegal status of\u00a0business operation, unscrupulous\u00a0agents are being irresponsible putting\u00a0their client\u2019s interest at risk in the\u00a0event of a legal dispute during the\u00a0process of a property transaction.\u00a0In pursue of their selfish gains in the\u00a0expense of their client\u2019s interest is a\u00a0gross breach of ethic in any business\u00a0sense, Wan says.\u00a0Fong Wai Choon, director of\u00a0Reapfield Properties (Hartamas),\u00a0agrees. \u201cWith effective from 1 June\u00a02014, all negotiators will also need\u00a0to register with the Board via their\u00a0companies they work with and they\u00a0will be issued an Authority to Practise\u00a0Tag after undergoing the necessary\u00a0training.<\/p>\n","protected":false},"excerpt":{"rendered":"
